SELLER TERMS & CONDITIONS
These Seller Terms & Conditions (“Seller T&C”) govern the access to and use of the marketplace platform operated by BAZAARDWAR INDIA – BAZAARDWAR.COM Website (“Platform Owner”, “we”, “us”, or “our”).
By registering as a seller (“Seller”, “you”, or “your”) and listing products or services on the Platform, you agree to be legally bound by these Seller T&C, the Platform Policies, and applicable laws of India.
1. DEFINITIONS
- “Platform” means the online marketplace operated by the Platform Owner.
- “Customer” means any end user purchasing products/services through the Platform.
- “Product(s)” means goods or services listed by the Seller.
- “Order” means a confirmed purchase placed by a Customer.
- “Commission” means fees payable to the Platform Owner.
- “Applicable Law” means all Indian laws, rules, regulations, and guidelines.
2. ELIGIBILITY & REGISTRATION
2.1 The Seller must be legally competent to contract under Indian law.
2.2 The Seller represents that all registration details, including GST, PAN, Bank details, and business licenses etc. are true and valid.
2.3 The Platform Owner reserves the right to approve, suspend, or reject any Seller registration at its sole discretion at any moment of time.
3. NATURE OF THE PLATFORM
3.1 The Platform is a technology-based marketplace facilitating transactions between Sellers and Customers.
3.2 The Platform Owner is not the seller, owner, or manufacturer of the Products.
3.3 The contract of sale is strictly between the Seller and the Customer.
4. SELLER OBLIGATIONS
The Seller agrees to:
- List only lawful, genuine, and compliant products
- Ensure accurate product descriptions, pricing, images, and specifications
- Maintain sufficient inventory to fulfil Orders
- Dispatch Orders within stipulated timelines
- Comply with GST, all Indian Taxation Laws, Consumer protection Laws, labelling, packaging, Labour Compliance Laws, Health, Safety & Environment Laws and all the laws of India
- Provide after-sales support as committed by the seller & as mandated by law
5. PROHIBITED PRODUCTS
The Seller shall not list:
- Illegal, counterfeit, or infringing products
- Banned or restricted items under Indian law
- Products violating Intellectual property rights
- Products violating Copyrights & Trademarks of other manufacturers/sellers etc.
- Products requiring licenses not held by the Seller
The Platform Owner may remove such listings without notice.
6. PRICING & TAXES
6.1 The Seller is solely responsible for determining product prices.
6.2 Product Prices must be inclusive of applicable GST.
6.3 The Seller shall issue legally compliant tax invoices to Customers.
6.4 Any tax liability arising from sales shall be borne by the Seller.
6.5 The Seller shall ensure all the compliance in line with the GST & all the laws of India.
7. COMMISSION & FEES
7.1 The Platform Owner shall charge Commissions, Payment gateway fees, Account & Subscription Fees, Return Handling fees, Refund fees, Penalties, Additional Fees & other Fees/charges etc. in line with the appended Seller Fee Structure.
7.2 The Platform Owner may revise Commission & fees without any prior notice.
7.3 Outstanding dues may be adjusted against Seller payouts.
8. PAYMENTS & SETTLEMENT
8.1 Payments shall be settled to the Seller’s registered bank account after deductions.
8.2 Settlement cycles shall be as per the Platform’s payment policy mentioned under the appended Seller Fee Structure.
8.3 The Platform Owner may withhold payments in cases of fraud, disputes, or legal orders.
9. ORDER FULFILLMENT & LOGISTICS
9.1 The Seller is responsible for proper product packaging, dispatch & delivery to the customer with customer satisfaction.
9.2 Title of Products passes to the Customer upon delivery.
9.3 Product Delays, cancellations, or non-fulfilment may attract penalties.
10. RETURNS, REFUNDS & CUSTOMER COMPLAINTS
10.1 Sellers must comply with the Platform’s Return and Refund policies.
10.2 Returns & Refunds related all the expenses shall be completely borne by the Seller.
10.3 Sellers shall promptly resolve customer grievances.
11. INTELLECTUAL PROPERTY
11.1 The Seller grants the Platform a non-exclusive, royalty-free license to use product content for platform operations and marketing.
11.2 The Seller warrants that listed content does not infringe third-party rights.
12. DATA PROTECTION & CONFIDENTIALITY
12.1 Sellers shall handle customer data in compliance with Indian data protection laws.
12.2 Confidential platform data shall not be disclosed or misused.
13. REPRESENTATIONS & WARRANTIES
The Seller represents that:
- It has lawful authority to sell listed products
- Products are authentic and safe
- All legal and regulatory compliances are fulfilled
14. INDEMNITY
The Seller agrees to indemnify and hold harmless the Platform Owner from any claims, losses, penalties, or damages arising from:
- Breach of these Seller T&C
- Product defects or misrepresentations
- Legal or regulatory violations
- Any other reasons etc.
15. LIMITATION OF LIABILITY
15.1 The Platform Owner shall not be liable for any kind of damages, direct/indirect or consequential damages etc.
15.2 Total liability shall not exceed the commission earned from the Seller in the preceding 1 month.
16. SUSPENSION & TERMINATION
16.1 The Platform Owner may suspend or terminate Seller access without notice for:
- Policy violations
- Fraud or misconduct
- Legal or regulatory risks
- Other reasons etc.
16.2 Upon termination, outstanding obligations from the Seller end must be fulfilled by the Seller within the stipulated timeline.
17. FORCE MAJEURE
Neither party shall be liable for delays or failures caused by the Force Majeure events beyond reasonable control.
18. GOVERNING LAW & DISPUTE RESOLUTION
18.1 These Seller T&C shall be governed by the laws of India.
18.2 Disputes shall be resolved by arbitration in India under the Arbitration and Conciliation (Amendment) Act, 2021.
18.3 Courts at Noida City, U.P., India shall have exclusive jurisdiction.
19. AMENDMENTS
The Platform Owner may modify these Seller T&C from time to time. Continued use constitutes acceptance.

SELLER FEE STRUCTURE
Below is our transparent and easy-to-understand fee structure for all the sellers, applicable as on date. However, all the Fees may vary at any point of time in future.
1. Account & Subscription Fees

Commission Fee is deducted automatically upon order completion.

5. Shipping Fees
The Seller dispatch the products through Self-shipping (Third Party Logistics Agencies) :
- Customer will directly pay the Shipping charges along with the Product cost, however, Seller is responsible for all the shipping co-ordination to ensure timely delivery & Returns of the products.
- Tracking number must be provided within 1 hour from the product dispatch.
6. Other Fees

6. Penalty Fees
To maintain platform quality.

7. Payout Schedule
- Payouts occur after 7 Days from the Product Delivery Date.
- Payment methods supported: Bank Transfer / UPI
8. Tax Information
- All the aforementioned fees are Exclusive of taxes, applicable GST to be paid Extra by the Seller.
- Sellers are responsible for complying with all the National/State/local tax laws & all the government / statutory norms, laws etc.
